Terms of Service

These terms are an agreement between you and Responsiv Marketing Agency, doing business as Speak To Send ("we", "us") for your use of Speak To Send at speaktosend.app (the "Service"). By creating an account or using the Service, you agree to them. If you use the Service for a business, you agree on its behalf and confirm you're allowed to.

1. Your account

• You must be at least 18 and give accurate details (your name and email).
• Keep your password safe. You're responsible for what happens under your account; tell us straight away at support@speaktosend.app if you think someone else has used it.
• During the beta, accounts are by invitation only.

2. What the Service does

Speak To Send helps you write emails in your own voice using artificial intelligence, then send them through your own GoHighLevel account: as email campaigns to contacts with the tags you choose, or as replies in your GoHighLevel conversations. You can also schedule emails, see your sending history, and buy extra writing credits.

3. Connecting GoHighLevel

• To use the Service you connect a GoHighLevel sub-account through GoHighLevel's Marketplace app. You authorise us to read the data the Service needs (contacts, tags, conversations, past email campaigns, users and sub-account details) and to create and send emails and replies on your behalf.
• Your use of GoHighLevel stays subject to your agreement with GoHighLevel. We are not responsible for GoHighLevel's service, availability or changes to it.
• You can disconnect at any time in Settings, which also removes the app from your GoHighLevel sub-account. Removing the app in GoHighLevel also ends our access.

4. Plans, billing and credits

• The Service is a paid subscription: $39 per month or $390 per year, billed in advance through our payment processor, Stripe. You choose and pay for a plan before connecting GoHighLevel. There is no free trial.
• Your plan renews automatically each month or year until you cancel. We'll tell you before any price change takes effect for you.
• Each plan includes 250 writing credits per month. One credit is used for each AI request: a draft, a requested change, a set of ideas or a reply. Setting up your voice profile does not use credits. Monthly credits reset each month and do not carry over.
• Extra credits can be bought as top-ups (100 credits for $10). Top-up credits do not expire while your account is open, and are used after your monthly credits.
• If you run out of credits, writing pauses until your credits renew or you buy more. Sending already-written emails and viewing your history keep working.
• Prices are in US dollars and exclude any taxes that apply.

5. Cancelling and refunds

• You can cancel anytime in Billing (Manage billing). Your plan keeps working until the end of the period you've paid for, then stops renewing.
• We don't give refunds for partial months or years, or for unused credits, except where the law requires it.
• If a payment fails, we'll keep your access for a short time while the payment is retried. If it still fails, writing and sending stop until the plan is paid.

Automatic renewal. When you subscribe, you authorise us to charge your payment method $39 every month or $390 every year (or the founding-member price you were offered), plus any taxes, until you cancel. Before you pay, the checkout page shows the price, how often you'll be charged, and that the plan renews automatically. After you subscribe, we email you a confirmation with how to cancel. For yearly plans, we email you a reminder at least 30 days before each renewal. You can cancel online at any time, as easily as you signed up: Billing → Manage billing → Cancel.

6. Your emails and the law

You are the sender of every email sent through the Service, and you're responsible for it. In particular you agree that:

• You only email people who have agreed to hear from you, or whom you're otherwise allowed to email under the laws that apply to you and them (for example CAN-SPAM in the US, CASL in Canada, and GDPR and PECR in the UK and EU).
• Your emails are truthful, identify you as the sender, and include your physical mailing address where the law requires it. Your from-address must be one you're allowed to use and that your GoHighLevel account is set up to send from.
• You honour unsubscribe requests. The Service adds an unsubscribe link to every email sent to more than one person and always leaves out contacts that GoHighLevel marks as unsubscribed or Do Not Disturb, but you remain responsible for your list and for any rules beyond that.
• You have the right to use the contact data, past emails and other material you bring into the Service.

7. AI-written content

• The Service uses AI to write drafts, suggest ideas and describe your writing style. AI can make mistakes: it can misunderstand what you said, get facts wrong, or produce something you wouldn't say.
• Always read an email before you send it. You're responsible for everything you choose to send. The Service shows you a final check (recipients, sender, subject and preview) and lets you send yourself a test first.
• You own the emails you send. To the extent we have any rights in the AI's output for your account, we give them to you.

8. Acceptable use

You must not use the Service to:

• send spam, or email people who haven't agreed to it, or use bought or scraped lists;
• send anything illegal, fraudulent, deceptive, harassing, hateful or sexually explicit, or that infringes someone else's rights;
• impersonate anyone, or hide who the sender is;
• send malware or phishing, or try to break, overload or get around the Service's limits and security;
• resell or share access to the Service without our written permission.

We may suspend or end accounts that break these rules, and we may pause a send that looks unlawful or harmful.

9. Your data

• Your data stays yours: your account details, voice profile, sample emails, drafts and settings, and the GoHighLevel data the Service reads for you.
• You give us permission to store and use it only to run the Service for you, as described in our Privacy Policy. We act on your behalf for your contacts' data, and where the EU or UK GDPR applies, our Data Processing Agreement is part of these terms.
• When you close your account, we delete your data as the Privacy Policy describes.

10. Other services we rely on

The Service uses GoHighLevel (your account and sending), Anthropic and OpenAI (AI writing and turning speech into text), Stripe (payments) and Railway (hosting). Their outages or changes can affect the Service. We're not responsible for their services, but we choose them carefully and tell you who they are in the Privacy Policy.

11. Beta

While the Service is in beta, features may change, and things may break. Beta testers may receive a founding-member price; it stays the same for the life of that subscription. If you cancel and come back later, you start a new subscription at the price offered then.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that the Service will be uninterrupted or error-free, that AI output will be accurate, or that your emails will be delivered or reach the inbox.

13. Limit of liability

To the fullest extent the law allows, we aren't liable for indirect or consequential losses (such as lost profits, revenue or data), and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. Nothing here limits liability that can't be limited by law.

You agree to cover us against claims arising from emails you send or from your breach of these terms.

14. Ending the agreement

• You can stop using the Service and cancel at any time.
• We may suspend or end your account if you break these terms, don't pay, or if we must for legal reasons. Where we reasonably can, we'll tell you first and give you a chance to fix it.
• If we stop offering the Service, we'll give at least 30 days' notice.

15. Changes to these terms

We may update these terms. We'll tell you by email or in the app at least 14 days before material changes take effect. Continuing to use the Service after that means you accept them.

16. Law and disputes

These terms are governed by the laws of the State of New Jersey, USA. Disputes go to the state or federal courts located in Cape May County, New Jersey, unless the law where you live says otherwise.

17. General

• Our app. The Service, its software, design and brand belong to us. We give you a personal, non-transferable right to use it for your business while your plan is active. You may not copy, resell, reverse engineer or build a competing product from it.
• Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
• Business use. The Service is for businesses and people acting for their business, not for personal or household use.
• AI providers' rules. You also agree not to use the Service in ways that break the usage policies of our AI providers (Anthropic and OpenAI), which our acceptable use rules in section 8 are meant to cover.
• Events outside our control. We're not responsible for delays or failures caused by events beyond our reasonable control, such as outages at GoHighLevel, our hosting or AI providers, internet failures, or natural disasters.
• Notices. We send notices to the email address on your account; you send them to support@speaktosend.app.
• Assignment. You may not transfer this agreement without our written consent. We may transfer it as part of a merger, acquisition or sale of the business, and will tell you if we do.
• Severability and waiver. If part of these terms can't be enforced, the rest still applies. Not enforcing a term straight away doesn't mean we give it up.
• Entire agreement. These terms, the Privacy Policy, and any order or offer you accepted (such as a founding-member price) are the whole agreement between us about the Service.
